What is the ruling on a charitable organization receiving confiscated vegetables and fruits, part of which is spoiled and the other part edible, that are confiscated from street vendors or due to the expiration of stall rental periods, knowing that refusing to receive them will lead to other organizations receiving them or their destruction?

Confiscation that is rightful: There is no harm in receiving it and distributing it to the poor, because it has become the property of the Bayt al-Mal (public treasury).

Confiscation that is wrongful: It falls under the ruling of usurped property, and it is forbidden to take possession of it or dispose of it. It must be returned to its owner. However, if it will be ruined in all cases, then giving it to the poor is preferable to letting it spoil.
