The question

Is it permissible to pay the full price of a forward sale (salam) to an intermediary upon signing the contract, on the condition that the intermediary delivers it to the seller upon the buyer's receipt of the goods, in exchange for a percentage, or to pay part of the price upon signing the contract and the remainder upon delivery?

The answer

The contract of salam (forward payment) requires the delivery of the capital to the seller in the contract session, based on the Prophet's (peace be upon him) saying: "Whoever makes a forward payment (salaf) should do so for a known measure." Otherwise, the contract becomes void, as it turns into a sale of debt for debt. If only a part of the capital is delivered in the session and the remainder is deferred, the salam is valid only for the amount received, according to the Hanafis, Shafi'is, and Hanbalis. However, the Malikis and Ibn Abi Layla consider it void for the entire transaction. As for delivering the capital to an intermediary, it is not considered possession by the seller because he has not taken ownership of the price. Scholars differed regarding the authority of a selling agent to take possession of the price. The Hanafis believe he does not do so, while the Shafi'is believe he has the authority to take possession and give possession if possession is a condition for the validity of the contract. The Hanbalis believe he has the authority to deliver the sold item but not to take possession of the price.
