The estate can only be determined, and the heirs and their shares identified, after the death of the deceased, and after settling debts and executing bequests, as Allah Almighty says: "But if you have a child, then for them [the wives] is one eighth of what you leave, after any bequest you [may have] made or debt." And Allah Almighty says: "Allah instructs you concerning your children: for the male, what is equal to the share of two females." We should note that inheritance matters are serious and complex, and cannot be resolved merely by a fatwa. Rather, they must be brought before the Sharia courts to secure the interests of both the living and the deceased.
