Is it permissible to contract marriage with a divorced woman before the completion of her waiting period (iddah) by another man?

The waiting period (iddah) for a divorced woman is not measured in months, unless she does not menstruate due to young age or old age. A non-pregnant woman observes a waiting period of three quru' (menstrual cycles). For a pregnant woman, her waiting period ends upon giving birth. If she is not pregnant and does not menstruate, her waiting period is three months.

It is not permissible to contract a marriage with a woman while she is observing her waiting period. Such a marriage is considered null and void by scholarly consensus and must be annulled immediately. If a man marries her knowing about the waiting period and the prohibition, and consummates the marriage, they are both considered adulterers. However, if they were ignorant of the waiting period or the prohibition, the lineage is established, the punishment (hadd) is averted, and the dowry becomes obligatory. If he knew but she did not, he is subject to the hadd punishment and the dowry, but the child's lineage is not attributed to him. If she knew but he did not, she is subject to the hadd punishment, she is not entitled to a dowry, and the child's lineage is attributed to him. As for a woman divorced before consummation, she is not required to observe an iddah, and there is no harm in contracting marriage with her on the day of her divorce.
