If the khul' (divorce at the wife's instance) has occurred, your wife is irrevocably separated from you (bānat), and it is unlawful for you to have intercourse with her. She does not become lawful for you except through a new marriage contract. If you had intercourse with her while knowing it was unlawful, then she must complete the iddah (waiting period) of khul', and then observe another iddah for fornication. You are not permitted to marry her until that iddah has expired. However, if you had intercourse with her believing it to be lawful, then this is intercourse based on a misconception (waṭ’ shubhah). The woman observes an iddah for this intercourse from the time it occurred, and it is permissible for you to marry her during this iddah, according to the preponderant opinion. The one who contracts her marriage is her guardian (walī) according to the well-known order of precedence.
