Does divorce take effect upon a woman twenty days after her delivery, while she is in a state of postnatal bleeding?

1 min readAlso available in العربية

If a woman becomes pure from postpartum bleeding (nifas), it is permissible to divorce her, and everything that was prohibited to her due to nifas becomes permissible. However, before she achieves purity, it is not permissible to divorce her, because it is an innovated (bid'i) and forbidden divorce. Nevertheless, it is considered valid by the majority of scholars, whereas Shaykh al-Islam Ibn Taymiyyah and those who agreed with him hold that it does not take effect. The more preponderant view is that of the majority.
