If the wife's adultery is proven, she has committed a grave transgression. If divorce was conditioned upon adultery and it occurred, then the divorce has taken effect. If this was the first or second divorce, and you had intercourse with her during her iddah (waiting period), then the رجعة (revocation of divorce) is considered to have occurred. However, if there was no iddah revocation, you must separate from her, and you can remarry her with a new mahr (dowry). If this was the third divorce, she is not lawful for you until she marries another husband. The child is attributed to you in all cases. It is advisable to protect your wife, oblige her to cover and wear hijab, prevent her from mixing or being in seclusion with men, and teach her matters of her religion. As for the oath, nothing is incumbent upon you because of it, and a Muslim should safeguard his oaths and beware of swearing by divorce.
