What is the ruling of the Shari'a regarding the homeowner who neglected the maintenance of the balcony railing, leading to a part of it falling on a worker and causing his death? Is diyah (blood money) or qisas (retaliation) obligatory upon him?

The homeowner guarantees the blood money (diyya) for the deceased person under three conditions: 1. If a tilt in the wall was apparent before its collapse. 2. If the homeowner was warned to repair the wall, unless the wall was built tilted from the start, in which case the warning is not a condition. 3. If it was possible to rectify the wall's condition.

If these conditions are met, the blood money is obligatory upon the 'aqila (male kin) of the homeowner, and he must also perform expiation for accidental killing: freeing a Muslim slave; if he cannot find one, then fasting for two consecutive months.
