What is the ruling on delaying the expiation for intercourse during Ramadan for several years, and what is the ruling on intercourse during the daytime in Ramadan while the husband is traveling, and is it permissible to give the expiation for intercourse to a single household that includes ten needy people?

1. Deliberately breaking the fast in Ramadan by engaging in sexual intercourse is a heinous sin.

2. If a husband has intercourse with his wife while fasting, after returning from travel, or before dawn, his fast is invalidated, and he is obligated to perform the major expiation for each day.

3. As for the wife, she only needs to make up the fasts (qada'), without expiation (kaffarah).

4. The expiation for intercourse during a Ramadan day is freeing a slave; if that is not possible, then fasting for two consecutive months; and if unable to do that, then feeding sixty needy persons. The majority of scholars mandate this order.

5. Making up the three days remains an obligation for both spouses. They also owe an expiation for delaying the make-up fasts for each day (750 grams of the staple food of the country), unless the delay was due to ignorance or forgetfulness.

6. It is permissible to distribute the expiation to sixty needy persons in six households (ten needy persons per household). However, according to the majority of scholars, feeding is only sufficient after being unable to fast.
