Is it permissible to seek divorce from a husband who frequently insults, curses, and threatens divorce, knowing that there was a valid private seclusion (khalwa shar'iyya) without the rupture of the hymen?

If the husband repeatedly insults and threatens to divorce, the wife has the right to seek divorce due to his ill-treatment. It is preferable for the wife to first try to advise her husband and reform him. If his character does not improve, then there is no blame upon her for seeking a divorce, especially if consummation has not occurred and they do not have children. If the husband has had a valid seclusion (khalwa sahihah) with the wife, she is entitled to the full mahr.
