What should a wife do with a husband who insistently invites her to sodomy, mistreats her, insults her and her family, does not pray, curses religion, breaks fast in Ramadan, and refuses to divorce her except for a large financial compensation that she cannot afford? Should she resort to the judiciary with a claim for divorce due to harm? And will the judge rule in her favor?

If it is proven that the husband curses religion, then he has apostatized, and his marriage is annulled. It is unlawful to cohabit with him until he repents. If he does not curse religion, then his commission of other evil deeds is sufficient for separation due to his iniquity. It is advised to refer his matter to the Sharia judge to remove the harm and for the judge to rule appropriately, whether by annulment or divorce.
