How is the inheritance divided if the heirs are: 7 sons, a father, a full brother, a mother, 3 daughters, and a pregnant wife?
The share of each heir from the deceased's estate is determined based on the existence of a pregnancy. In this case:
- Each parent (father and mother) receives one-sixth due to the presence of a lineal descendant.
- The wife receives one-eighth due to the presence of a lineal descendant.
- The remainder goes to the children and the fetus (if born alive), with the male receiving the share of two females.
- The division of the inheritance is suspended until the matter of the pregnancy is clarified.
- It is possible to expedite the distribution of shares for those whose portions are not affected by the pregnancy (the father, mother, and wife). Thus, the father is given four shares, the mother four shares, and the wife three shares, out of a total of twenty-four. Thirteen shares remain suspended for the fetus.
