Is it permissible for me to take an additional commission from the governmental buyer, after agreeing with the seller on a previous commission, knowing that the additional commission will be paid to a government employee to facilitate the completion of the sale?

The agreement between the seller and the buyer on a price that includes a commission is permissible, and there is no obligation to inform the buyer of it, unless the seller of the commodity is an agent for the buyer. However, an increase in the price of a commodity due to a commission given to a government employee who signs off on a transaction, without the knowledge of his employer, is impermissible. This is because it constitutes fraud, forgery, and unlawful acquisition of money. Furthermore, the employee is an agent for the government entity, and he has no right to take a commission for himself without the knowledge of his principal. Moreover, he already receives a salary for his work. The Prophet, peace and blessings be upon him, forbade gifts to workers. Al-Bukhari and Muslim narrated that the Prophet, peace and blessings be upon him, said: "What is wrong with an employee whom I send, and he says: 'This is for you and this was given to me as a gift'? Why does he not stay in his father's house or his mother's house to see if anything is gifted to him or not?" Abu Dawud narrated that the Prophet, peace and blessings be upon him, said: "Whoever we employ for a task, let him bring its little and its much. What is given to him, he takes, and what he is forbidden from, he stops."
