If a husband swears to divorce his wife if he returns to anal intercourse, and then he does it, one divorce occurs, even if the act is repeated. This is unless the husband uses a phrase that implies repetition, such as "Every time I do such and such, you are divorced," in which case a divorce occurs with each act of intercourse. The validity of the divorce does not depend on the husband's intention or whether the wife is pregnant. Some scholars are of the opinion that the one who swears by divorce is only obligated to offer an expiation for an oath.

The wife must refuse if the husband wishes to commit a forbidden act, and both of them must repent to Allah.
