Does a divorce take effect if the wife does something upon which the husband conditioned her divorce, and then he regrets it and retracts?
The fatwa we adhere to is that whoever makes his wife's divorce conditional upon a stipulation cannot retract it, and if the stipulation is met, his wife is divorced.
According to Ibn Taymiyyah, if he intended for the divorce to occur upon the fulfillment of the condition, he may retract the condition. However, if he did not intend for the divorce to occur, but rather intended to threaten, emphasize, or prevent, then the divorce does not take place. Instead, he is required to pay an expiation for a broken oath (kaffarat yameen) for his breach.
