What is the ruling regarding the husband's statement, "My life is forbidden to me," without intending divorce, and his statement, "If you want to remain under my care, get out of my sight," followed by the wife's return? What is the ruling regarding situations where there is no explicit wording or intention of divorce? Is the wife sinful? And how can she ascertain her husband's intention?

If a husband tells his wife, "You are unlawful to me" (عليّ الحرام) without intending divorce, his wife is not divorced. He is, however, obligated to pay an expiation for ẓihār or an expiation for an oath, depending on his intention.

As for the husband's statement, "If you want to remain under my marital bond...", this does not constitute a divorce, as it is neither an explicit statement of divorce nor an ambiguous one (kināyah). What matters regarding the husband's intention is his own declaration, as he knows his intention best.

The wife is obligated to obey her husband in what he commands her to do, as long as it is within what is considered good and lawful (maʿrūf).
