The phrase "Consider yourself divorced" is regarded by some scholars as an explicit divorce (talaq sareeh), while many contemporary scholars consider it a metaphorical expression of divorce (kinayat al-talaq). According to the latter view, which is the basis of the fatwa, divorce does not occur by this phrase unless there is an intention (niyyah) to divorce. So, if the husband did not intend divorce but rather intended to threaten, then divorce does not take place.
