What is the ruling on selling grape leaves and grapes while they are still on the tree before the grapes appear or when the grapes are unripe ("حصرم")?

It is not permissible to sell fruits before their ripeness appears, because the Prophet, peace and blessings be upon him, forbade that, out of fear of the fruit perishing or being afflicted by a blight. An exception to this is if the fruit is sold with its origin (the tree), or if it is sold on condition of being cut immediately and utilized (like sour grapes). However, delaying its cutting after the sale invalidates the sale according to some scholars.

Based on this: It is permissible to sell grape leaves individually if they can be utilized. It is also permissible to sell them with grapes on condition of cutting them while they are sour (unripe). It is permissible to sell grapes before their ripeness appears if they are sold with their tree. However, it is not permissible to sell grapes before their ripeness appears without the condition of cutting or without their tree.

To overcome the difficulty of selling the leaves individually, the owner of the orchard can cut them himself and then sell them cut, while leaving what preserves the grape fruit.
