What is the ruling of Islamic law regarding a husband who does not repay his wife a loan that she intended as a charity for the sake of Allah?
If the money is given for a qard hasan (a benevolent loan), then lending is desirable in Islamic law, especially to someone in need. The husband is the most deserving person of this kindness. If the wife lends to her husband, she has done something praiseworthy. The wealthy husband should repay the loan upon request. If he is in hardship, she should grant him respite until he is able to repay it. Giving it to him as charity is better. However, if she originally intended the money as charity and her husband borrowed it, then if he is in hardship, she should give it to him as charity. If he is wealthy, he should return it so she can give it as charity to someone else.
