What is the ruling on excess money that workers receive after they have agreed to a reduced wage?
If the company owner entered into a two-year lease contract with the workers for 4,0 Saudi Riyals per month, then the contract is binding, and he must pay the full wage as long as the workers are committed to the work. His refusal to pay, citing the deterioration of work, is not an excuse.
If the workers accept the new wage without coercion, then this is a mutual rescission (iqalah) and an agreement to terminate the first contract. Mutual rescission is valid in lease agreements.
Accordingly: If the workers do not agree to the company owner's rescission, then the first contract remains, and they are entitled to what they have earned. If they accept it, then they should return the amount exceeding the new wage to the employer.
