Is a divorce enacted if a couple travels for Umrah after the husband uttered the words of divorce in a state of anger, and then regretted what he said?
The authoritative fatwa (legal opinion) with us is that divorce occurs if the wife goes to Mecca, as long as the husband uttered what he said while conscious. If it is less than three divorces, he has the right to take her back during her 'iddah (waiting period). Some scholars, like Ibn Taymiyyah, are of the view that divorce does not occur in this situation, as long as the husband did not intend to effect a divorce, but rather intended to threaten and prevent, and the husband is required to pay expiation for breaking an oath.
