Is sitting in bed for five minutes or more after waking up from sleep after sunrise, and then praying, considered intentional delay of prayer from its prescribed time, and does this entail sin?
There is no sin upon one who sleeps through a prayer until its time has passed, without negligence on their part, based on the saying of the Prophet, peace and blessings be upon him: "There is no negligence in sleep. Negligence is only for one who does not pray a prayer until the time for the next prayer comes. So, whoever does that, let him pray it when he remembers it."
However, habitually sleeping through Fajr prayer requires treatment and taking the means to wake up, because some scholars hold that it is obligatory to take the means to wake up, and that one who is negligent in this sins.
After waking up from sleep, one must immediately perform the prayer and fulfill its conditions, because the time at which one woke up becomes its time, and any delay thereafter is considered delaying the prayer beyond its time. Making up missed prayers is obligatory immediately according to the majority of scholars. The proof for this is the saying of the Messenger of Allah, peace and blessings be upon him: "Whoever forgets a prayer, let him pray it when he remembers it. There is no expiation for it except that." In a narration by Muslim: "Whoever forgets a prayer, or sleeps through it, its expiation is to pray it when he remembers it."
