Is it permissible for me to adopt the fatwa of Ibn Baz, Ibn Uthaymeen, and Ibn Taymiyyah regarding the non-occurrence of divorce during menstruation, despite the repeated utterance of the word of divorce, in order to avert harm, especially since we have an infant child?

Divorce pronounced during menstruation is effective according to the majority of scholars, and this is the fatwa we adhere to. However, there is no harm in adopting the opinion of those who do not consider it effective if your heart is at ease with it. Divorce issued by someone suffering from obsessive-compulsive disorder (waswas) does not take effect. We advise presenting the matter to the Sharia court or to the scholars in your country.
