What is the ruling on intentionally breaking the fast during the expiatory fast for unintentional killing due to severe hunger, and is it obligatory to re-fast for the two months?
Scholars hold two opinions regarding the interruption of continuity due to breaking the fast out of overwhelming hunger: some believe the continuity is broken, while others do not. The adopted by us is that mere hunger is not a permissible excuse to break the fast, unless the Muslim fears perishing or harm to himself; in which case, it is permissible for him to break the fast to avert harm. If the severity of hunger reaches this state, the continuity of the fast is not broken, and the days already fasted are counted. However, if the severity of hunger does not reach that state and the fast is broken, the continuity is interrupted, and it becomes necessary to resume fasting from the beginning.
