Does a divorce occur when a man says to his wife, "I hate you," while angry and intending divorce?

A man's statement to his wife, "I hate you," is neither an explicit declaration of divorce (sareeh) nor an ambiguous one (kinayah). Divorce does not occur with this statement unless he intends to effectuate divorce by it, according to the Maliki school. As for the majority of scholars (jumhur), they do not consider it a divorce at all. In this case, as long as the man did not intend to effectuate divorce with this statement, divorce does not occur according to all scholars.
