Does the solicitor deserve a share of the money earned by someone who invested the money given to him to buy a plot of land, and then bought the land for him after he requested it?

If a person invests money deposited with him as a trust (amanah) without the owner's permission, the profit is to be divided between them as in a Mudarabah (profit-sharing) arrangement. This is the most just opinion, because the profit is a result of both capital and labor. Some scholars are of the view that the entire profit belongs either to the owner of the money or to the usurper. Sheikh Al-Islam Ibn Taymiyyah issued a fatwa stating that this is justice, and Sheikh Ibn Baz agreed with him that the one who disposes of money without the owner's permission must seek his forgiveness, or give him the profit of his money, or reconcile with him on a portion of the profit. The profit is divided according to what is customary in Mudarabah. If the owner of the money forgives anything, then that is his. However, if the usurper bought the land for more than what he was given, they divide the profit, and the excess amount paid for the land's price is deducted from it.
