Is a husband's statement to his wife during an argument, "This is how it is," or "The solution is known: either we live together or we divorce," or "Tomorrow I'll find a solution," with the intention of divorce, considered a divorce? What is the ruling on intention in allusive divorce when angry? What is the ruling on wishing for divorce and self-talk about it? And is he sinful if he acts upon a Sheikh's fatwa that the divorce did not occur?

A husband's statement to his wife, "khalas" (enough/it's over) or "khallas" (it's done), without the intention of divorce, does not constitute a divorce. Similarly, the phrase "the solution is known: either we live together or we divorce" does not constitute a divorce. Likewise, "tomorrow I'll find a solution," if intended as a divorce, is merely a promise of divorce and does not constitute it. Divorce occurs when the tongue and lips are moved to utter the letters. However, if it is merely intrusive thoughts (waswasa) or doubt about its occurrence, the default is that it has not occurred. One should disregard intrusive thoughts and seek Allah's help to get rid of them.
