Should one arriving in Makkah for Umrah from Riyadh, after reaching and resting from fatigue, assume ihram from the miqat for the people of Najd (As-Sail Al-Kabeer), or is he considered among the people of Makkah and thus assumes ihram from his location?
If you arrived in Mecca without the intention of performing , and then decided to perform it, you must enter into a state of from the nearest point outside the boundary (adna al-hill). However, if you had intended to perform Umrah before arriving in Mecca, then it is obligatory to enter into a state of ihram from the designated . The desire for rest after arrival does not preclude entering into ihram; rather, you could have entered into ihram and remained in that state, then performed Umrah once you felt rested.
What is now obligatory is for you to return to Al-Sail Al-Kabeer and enter into ihram from there. It is not permissible to enter into ihram from Mecca. If you do so, you will be sinful and obligated to offer a sacrifice (dam), which you must slaughter and distribute to the poor of the Haram, for having neglected one of the obligatory rites of Umrah.
