Does a divorce take effect for one who says, "Upon me be divorce that I do not do such-and-such" falsely, without having sworn an oath, knowing that Sheikh Saleh Al-Munajjid mentioned that this does not take effect even if he intended thereby its creation?

If a person claims to have sworn an oath of divorce (talaq (definition)) but did not actually swear it, the preponderant view is that he does not become a swearer (halif), and the divorce does not religiously take effect due to the action he claimed to have sworn upon. This is because it is not an oath, but rather a false statement about an oath. Ibn Qudamah mentioned that Ahmad said: "It is a lie; there is no oath upon him."
