Does a pregnant woman's divorce take effect?
Some common folk believe that a pregnant woman cannot be divorced, but there is no basis for this in the words of scholars. Rather, all scholars unanimously agree that a pregnant woman can be divorced, and this is a consensus with no differing opinions. The divorce is for a woman to be divorced in two situations: while she is pregnant, or while she is ritually pure and her husband has not touched her. If a man takes back his pregnant wife during her waiting period, she becomes his wife, because her waiting period ends upon delivery, and her husband took her back before that. Allah the Almighty says: (And for those who are pregnant, their term is that they deliver their burden) (Surat At-/4). The husband should count this as one divorce.
