The question

Does divorce take effect if the wife says, "You'll be divorced by me [or, I will seek Khul' from you]," and then the husband repeats, "May you and your mother be divorced by me [or, may Khul' befall you and your mother]?" And does divorce take effect with the phrase, "May you be divorced [or, may a divorce befall you]"? And are "release" (tasrih) and "separation" (firaq) among the explicit wordings of divorce?

The answer

Divorce does not occur with the words "khul'a" (annulment) or "talqa" (a single divorce) if the intention behind them was not to initiate divorce, but rather to curse her. Such jesting should be avoided. As for the words "al-firaq" (separation) and "al-sarah" (release), scholars have differed on whether they are explicit terms for divorce.
