The question

Must a woman who has been divorced and has received her deferred dower (mu'akhkhar sadaq) be given a new dower, with an advance (muqaddam) and a deferred (mu'akhkhar) portion, if she returns to her husband, or should she return what she received, and have it written in the new contract?

The answer

If a man divorces his wife with a revocable divorce (ṭalāq rajʿī) and her waiting period (ʿiddah) expires, or if she becomes irrevocably separated from him, whether by a minor or major irrevocable divorce (baynūnah ṣughrā or kubrā), and she subsequently marries another man, and then this second husband divorces her or dies, and her waiting period (ʿiddah) from him expires, then if the first husband wishes to return to her, it is necessary to have a new marriage contract (ʿaqd jadīd) with her consent, a new dowry (mahr jadīd), a guardian (walī), and witnesses. He does not have the right to reclaim any part of thew previous dowry or any rights that she received from him during the previous marriage.
