What should a girl do about returning the dowry that the husband refused to accept, and what is the waiting period (iddah) for her after divorce?
If a man divorces his wife without stipulating the return of the dowry, then the dowry is her right. If he divorces her in exchange for a sum of money, and then willingly leaves it for her, there is no harm in her benefiting from it. As for the waiting period ('), it is obligatory upon her: three menstrual cycles for a menstruating woman, three months for a woman who has despaired of menstruation, and delivery for a pregnant woman. In the case of khulʿ (divorce at the wife's instance, often for a compensation) or divorce in exchange for money, the majority of scholars hold that the waiting period is the same as that of a divorced woman. However, some scholars believe it is one menstrual cycle for a menstruating woman, or one month for a woman who does not menstruate.
