The marriage of disbelievers is valid, and they are affirmed in it if they embrace Islam. The manner of their contract or the conditions of Muslim marriages, such as a guardian and witnesses, are not considered, and this is by the consensus of scholars. Scholars have unanimously agreed on the continuity of the marriage if both spouses embrace Islam together, unless there is a lineage or fosterage relationship between them. This is established by continuous transmission (tawatur) from the actions of the Prophet, peace and blessings be upon him, with those who embraced Islam.
