What is the ruling regarding the marriage of a woman to whom her husband said, in a moment of anger, "I will have intercourse with my mother if you remain my wife tonight," and cursed her religion and her Lord, then said to her, "You are divorced," knowing that he later regretted it and did not remember what he had said?

If the husband does not comprehend what he is saying due to anger, he is not held accountable for any insults or curses he utters, nor does his divorce take effect. However, if he pronounces divorce while fully aware of what he is saying, then the divorce takes effect. If this was not the third pronouncement of divorce, he may take his wife back during her iddah (definition) (waiting period) without a new contract, or with a new contract if the iddah has ended. Both spouses must avoid problems and exercise wisdom, and a Muslim should beware of anger.
