Imam Al-Shafi'i stated that the divorce pronounced by someone whose mind is overwhelmed by nature or ailment (such as the imbecile, the insane, and the obsessive) is not binding on him, nor are prayer or prescribed punishments binding on him as long as his mind is overwhelmed. However, if he regains lucidity and divorces while lucid, then the divorce is binding on him.
