Ta'zir is legislated for those who abandon an obligation or commit a forbidden act for which there is no prescribed punishment (ḥadd), such as theft below the prescribed threshold (niṣāb), consuming usury (ribā), deception (ghish), bearing false witness, kissing or being in seclusion with a non- woman, and not wearing the legal . It is a discretionary punishment, not pre-determined by Islamic law, that becomes obligatory as a right of Allah or a human being for every sin that generally does not have a prescribed punishment (ḥadd) or an expiation (kaffāra).
