A man who does not adhere to the pillars of Islam is in grave danger, and he should be advised to repent and prayed for to become righteous. He should also be advised to fear Allah in his dealings with people, and some virtuous and righteous individuals should be assigned to him to rectify his situation. If the mediators fail to convince him, it is permissible to resort to man-made laws to repel injustice. Selling the house is a solution to the problem, and reclaiming one's right is permissible with caution. There is no harm in performing Hajj before the problem is resolved if one has the ability to do so; in fact, one must hasten to perform it if it is the Hajj of Islam.
