The question

What is the ruling on assuming ihram for someone who arrived in Jeddah for a worldly purpose and then intended to perform Umrah? Should he assume ihram from Jeddah or from the Miqat? And what is incumbent upon someone who arrived in Jeddah without ihram? Is it sufficient to merely make the intention on the plane when parallel to the Miqat, or is it necessary to remove sewn garments therein? And is it sufficient to assume ihram from the nearest Miqat for someone who has passed their original Miqat?

The answer

It is not permissible for someone intending Hajj or ' to pass the Mīqāt without Ihrām. If they pass with an intention and then decide to perform 'Umrah while in Jeddah or elsewhere, they should enter Ihrām from their current location, and their 'Umrah will be valid.

Whoever is obligated to enter Ihrām and intentionally passes the Mīqāt is sinful. However, if it was by mistake, ignorance, or forgetfulness, there is no sin upon them, and they must return to the Mīqāt to enter Ihrām from there. There is no compensatory sacrifice (dam) required according to the Shāfi'ī, Hanbalī, and Mālikī schools. If they are unable to return, they should enter Ihrām from their current location, and a dam is required.

Whoever enters Ihrām from the Mīqāt but intentionally remains wearing sewn clothing is sinful and must offer a (expiation: fasting for three days, or feeding six needy persons, or sacrificing a sheep). If it was due to forgetfulness, ignorance, or mistake, there is no sin upon them, and some scholars do not obligate them to offer the fidyah.

It is permissible for someone who has passed their designated Mīqāt without Ihrām to enter Ihrām from another Mīqāt, provided that the distance between them and Mecca is equal to the distance of the Mīqāt they bypassed.
