Heirs are not entitled to anything from the deceased’s estate until after his debts are paid and his will is executed, as Allah Almighty says: "after any legacy he may have bequeathed or any debt." It is obligatory to promptly pay the deceased’s debt from his estate, as the Prophet (peace be upon him) said: "The soul of a believer remains suspended by his debt until it is paid off on his behalf." Therefore, heirs do not have the right to object to the sale of properties to pay off the debt, because it takes precedence over their right to the inheritance. The hindrance of sustenance may be due to sins and violations of Islamic law, as Allah Almighty says: "And whatever calamity befalls you, it is because of what your hands have earned," and the Prophet (peace be upon him) said: "Indeed, a servant is deprived of provision because of a sin he commits." Hence, it is necessary to promptly pay off the father's debts from his money.
