What is the ruling on one who had intercourse with his wife during the daytime in Ramadan, using a condom, knowing that the wife complied based on a fatwa the husband heard stating that the condom prevents the contact of the two circumcised parts, thus not constituting intercourse?

Sexual intercourse is forbidden during the daytime in Ramadan (definition). It invalidates the fast, even if a condom is used, because it satisfies one's lust and carries the same rulings as intercourse, such as the obligation of ghusl (definition) (ritual bath) and the invalidation of the act of worship. Whoever commits this act must repent, make up for that day, and offer expiation, which is freeing a slave. If one cannot find a slave, then fasting for two consecutive months. If one is unable to do that, then feeding sixty poor people.
