What is entailed for someone who, out of forgetfulness, uncovered his upper torso and placed the ihram garment over his head while relieving himself on the Day of Arafat, then remembered that covering the head is prohibited for someone in a state of ihram, but delayed uncovering his head for fear of soiling his lower garment, knowing that he possessed a spare ihram garment? Is a fidyah incumbent upon him?

Whoever covers his head while in the state of ihram (definition) out of forgetfulness is not liable for anything. If the pilgrim remembers that he has committed a prohibited act, he must remove it immediately. There is no sin upon him if he maintains the covering out of necessity, but he is required to offer a fidyah (definition) as a precaution (fasting three days, or feeding six poor people, or slaughtering a sheep).
