Is the third divorce (talaq) that occurred during a period of purity (tuhr) in which the husband had intercourse considered an innovated and forbidden divorce, thereby allowing the wife to return to her husband, bearing in mind that she is breastfeeding and her menstrual period may be delayed due to breastfeeding?

If the husband pronounces divorce three times: the first time the wife did not hear it but it occurred, the second time while she was in a state of postnatal bleeding (nifas (definition)), and the third time during a period of purity (tuhr) in which he had intercourse with her, then she becomes unlawful for him and is not permissible for him until she marries another husband in a desired marriage and he divorces her after consummation. This is the view of the majority of scholars. It is advisable to refer to the Sharia (definition) court.
