Is it permissible to adopt the view of one who does not consider a bid'i divorce to have occurred, even if it was a suspended divorce and the condition was intentionally met at a time when divorce is impermissible (such as during menstruation)?

The issues of Bid'i divorce (innovated divorce) and retracting a conditional divorce are matters of scholarly disagreement. If a student of knowledge finds the opinion that Bid'i divorce does not occur and that it is permissible to retract a conditional divorce to be stronger based on the evidence, then he may adopt it. Similarly, an ordinary person may follow the fatwa (definition) of someone he trusts, in accordance with Allah's saying: "So ask the people of the message if you do not know." (An-Nahl: 43). However, no one is permitted to adopt any of these opinions merely out of personal desire or to seek out concessions.
