What is the ruling on a husband having intercourse with his wife out of ignorance of the ruling on ẓihār, and what is the ruling on enjoying her with foreplay short of intercourse after commencing the fasting for the expiation of ẓihār, and is it obligatory to repeat the two months of fasting in this case?

Touching the wife before the expiation due to ignorance of the ruling does not necessitate anything beyond the expiation. The wife's enjoyment of foreplay during the expiation is forbidden according to the majority of scholars, and it is safer to adopt their view. Regarding one who has intercourse while performing expiation through fasting, scholars differ on whether this breaks the continuity of their fasting. Some believe that the previous days of fasting are invalidated and that the two months must be restarted, while others believe that the continuity is not broken. If we say that direct physical contact (mubasharah) is like intercourse (wat'an) in its prohibition, then it breaks the continuity. There is no harm in acting upon the opinion of those who do not require restarting the fast and allow building upon what has passed, but it is better to restart the fast as a matter of precaution.
