What is the share of the wife, two daughters, and sisters from the inheritance?
If a man dies leaving a wife, two daughters, and full sisters or paternal half-sisters only, and he has no other heirs (such as a father, mother, grandfather, or brothers), then the inheritance is divided as follows: the wife receives one-eighth, based on the Almighty’s saying: ﴿But if you have a child, then for them is one eighth of what you leave﴾. The two daughters receive two-thirds, based on the Almighty’s saying: ﴿But if there are [only] daughters, two or more, for them is two-thirds of what he left﴾. The remainder goes to the sisters by virtue of ta’sib (residuary heirship). Thus, the inheritance is divided into twenty-four shares: the wife receives three, the two daughters sixteen, and the sisters seven.
We caution that matters of inheritance are serious and complex, and a mere fatwa is insufficient. Rather, the case must be referred to the Sharia courts to verify the absence of any other heirs, wills, or debts that take precedence over the heirs’ rights.
