Is the money paid as compensation for damages permissible for me, or must it be donated to mosques?
Clarifying the nature of the damage determines the ruling on compensating the one hundred thousand:
- If the damage is moral, then it is not permissible to take compensation, and the money must be returned to its owner. Donating it to the mosque is not sufficient.
- If the damage is material:
- If the relationship was an employment contract with a salary, then you are entitled to the agreed-upon salary or the fair wage, with the difference to be returned if what you took was more.
- If the relationship was a (profit-sharing) contract, then you are entitled to your agreed-upon share of the profit upon the liquidation of the partnership.
Contracts and conditions must be fulfilled, and donating to the mosque does not absolve one from returning rights to their rightful owners.
