What is the 'iddah for a minor if her husband divorces her before consummating the marriage, given that her 'iddah is three months according to the fourth verse of Surat At-Talaq? The marriage of a minor who has not reached puberty is permissible according to the majority of scholars. They cite as evidence the noble verse: "And those who have not menstruated," and the marriage of the Prophet, peace and blessings be upon him, to Aisha when she was young. As for her handover to her husband, it occurs, according to the majority, after she grows up and is able to endure intercourse. The waiting period (iddah) becomes obligatory upon privacy with a wife who is able to have intercourse, and not only upon intercourse itself. A minor who cannot endure intercourse is not obligated to observe the iddah upon privacy. It is recommended that the father not marry off his minor daughter before she reaches puberty and he seeks her permission.
