Am I entitled to seek divorce after many years of enduring harm and humiliation, and what is the ruling on not giving the husband his marital rights if I remain with him against my will?

Divorce is the most detestable of lawful acts to Allah. It is not permissible for a woman to seek divorce without a valid reason; otherwise, she is sinful. The Hadith states: "Any woman who asks her husband for a divorce without a valid cause, the scent of Paradise will be forbidden to her."

Valid reasons for divorce include harm inflicted by the husband due to ill-treatment, failure to provide conjugal rights, abuse such as cursing and insults, or unlawfully taking money.

As long as a woman is under the marital bond and her husband fulfills her rights, it is not permissible for her to deny him his marital rights or be negligent in them. It is forbidden for her to refuse his bed if he calls her without a legitimate excuse, as the Prophet, peace and blessings be upon him, said: "If a man calls his wife to his bed, and she refuses to come to him, and he spends the night angry with her, the angels curse her until the morning."

If a woman dislikes her husband and does not wish to associate with him, she must be patient and try to resolve disputes amicably. If amicable solutions do not work, and she fears neglecting his marital rights due to her aversion, then she may seek khul‘ (divorce initiated by the wife by returning the dower).
