Is a woman entitled to seek divorce from her husband who abandons her, mistreats her, and neglects her marital rights, given that he refuses to divorce her?

If a husband neglects his wife, fails to fulfill her due rights, and harms her, there is no sin upon her for seeking a divorce. This would not be an injustice to the husband, because the forbidden seeking of divorce is that which is without a valid reason, as the Prophet (peace be upon him) said: "Any woman who asks her husband for a divorce without any strong reason, the scent of Paradise will be forbidden to her."

However, it is advisable not to rush into seeking a divorce and to strive for understanding with the husband to live with her in kindness. If this is not possible, then an arbitrator from his family and an arbitrator from her family should intervene to reconcile them, or to separate them if reconciliation is impossible.
